1. Acceptance of Terms

By using this website or contacting us to request services, you confirm that you are at least 18 years old and have the legal authority to enter into a contract. These Terms constitute a legally binding agreement between you and Tracy Concrete Company.

2. Description of Services

Tracy Concrete Company provides concrete contractor services including but not limited to driveway building, patio construction, stamped concrete, sidewalk building, garage floors, decorative concrete, retaining walls, floor installation, pool decks, steps construction, slab foundations, foundation installation, parking lot building, concrete footings, foundation raising, and concrete cutting.

Services are provided in Tracy, CA and surrounding areas. We reserve the right to decline service requests at our discretion.

3. Estimates and Pricing

All estimates provided - whether by phone, email, online form, or in person - are non-binding until a written contract is signed by both parties. Estimates are based on the information available at the time of assessment. Final pricing may change if:

• Site conditions discovered after work begins differ materially from what was visible during the estimate
• The scope of work requested by the customer changes after the estimate is issued
• Material prices change significantly between the estimate date and the scheduled work date

Any change to the original estimate will be communicated to the customer in writing before additional work proceeds.

4. Scheduling and Cancellation

Work is scheduled based on crew availability, material delivery, weather conditions, and permit approval timelines. We will provide you with a scheduled start date or window and will notify you of any changes as early as possible.

If you need to cancel or reschedule a confirmed job, please contact us as soon as possible. Cancellations made with less than 48 hours notice after materials have been ordered or permits have been pulled may result in fees to cover those costs. Any applicable cancellation fees will be communicated to you in your written contract.

We reserve the right to reschedule jobs due to unsafe weather conditions, including extreme heat, rain, or other conditions that would compromise the quality of the finished work.

5. Payment Terms

Payment terms are specified in the written contract for each job. In general:

• A deposit may be required prior to scheduling, as specified in the contract
• The remaining balance is due upon completion of the work, unless otherwise agreed in writing
• Accepted payment methods will be specified in the contract

Late payments may be subject to interest charges as permitted under California law. In the event of non-payment, Tracy Concrete Company reserves the right to pursue all available legal remedies, including filing a mechanics lien against the property.

6. Customer Responsibilities

You are responsible for:

• Providing accurate information about the project site and any known underground utilities
• Clearing the work area of personal property, vehicles, and obstacles before the scheduled start date
• Obtaining any required homeowners association approvals before work begins
• Keeping children, pets, and other individuals clear of the work area during active work and during the concrete curing period
• Following all care and maintenance instructions provided upon project completion

7. Warranty Disclaimers

We stand behind the quality of our work and will address any defects in materials or workmanship that arise within the warranty period stated in your written contract, subject to the following exclusions:

• Damage caused by improper care or maintenance after project completion
• Normal wear and expansion or contraction cracking that is expected with concrete over time
• Damage caused by tree roots, underground utility movement, or other third-party factors
• Damage resulting from use of the surface in a manner inconsistent with the specifications (e.g., parking heavy equipment on a residential-rated slab)

THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, BEYOND THOSE STATED IN THE WRITTEN CONTRACT. ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Tracy Concrete Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or these Terms, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the services provided shall not exceed the total amount paid by you for the specific project giving rise to the claim.

9. Website Use

This website and its content are provided for informational purposes only. You may not reproduce, distribute, or otherwise use any content from this website without our prior written permission. We reserve the right to update or remove any website content at any time.

You agree not to use this website for any unlawful purpose or in any way that could damage, disable, or impair our website or servers.

10. Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or our services, both parties agree to first attempt to resolve the dispute informally by contacting us at the information below. If the dispute cannot be resolved informally within 30 days, the parties agree to submit to binding arbitration in CA, conducted under the rules of the American Arbitration Association.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court where appropriate.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute not subject to arbitration shall be resolved in the courts of San Joaquin County, California.

12. Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of this website or our services after changes are posted constitutes your acceptance of the updated Terms.
